Bysjdm respects the intellectual property rights of game developers, artists, publishers, and other creators. Most of the games on the site are licensed by their developers for free distribution, and we make a good-faith effort to confirm that we have the right to host each title. If you believe that something on the site infringes your copyright, the procedure below explains how to notify us, how we handle valid notices, and how to file a counter-notice if you believe a removal was made in error.

1. Designated Agent

Our designated agent for DMCA notices can be reached at alwynsknsb0186ecaoksn@gmail.com with the subject line "DMCA Notice - [Game Title]". Please send all takedown requests, counter-notices, and related correspondence to that address.

2. How to File a Takedown Notice

To be effective under the United States Digital Millennium Copyright Act (17 U.S.C. § 512), a notification of claimed infringement must include the following:

• A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright's interest.
• Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information sufficient to permit us to locate the material on the site (such as the URL of the game page or a clear description of where the material appears).
• Contact information for the complaining party, including name, address, telephone number, and email address.
• A statement that the complaining party has a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notification is accurate and that the complaining party is authorized to act on behalf of the owner of the copyright's interest.

3. How We Process a Valid Notice

When we receive a notification that meets the requirements above, we typically take the following steps:

• Confirm that the notification contains the required elements.
• Temporarily remove or disable access to the allegedly infringing material.
• Attempt to notify the developer or publisher of the affected game so that they have an opportunity to respond.
• Review the underlying licensing documentation, if any, that the developer has provided to us.
• Restore, modify, or permanently remove the material based on the outcome of our review.

Most straightforward cases are resolved within seven business days. Cases that involve a counter-notice can take longer, as required by the statute.

4. Counter-Notice Procedure

If you believe that material you posted or distributed was removed (or to which access was disabled) as a result of a mistake or misidentification, you may file a counter-notice with us. To be effective, a counter-notice must include:

• Your physical or electronic signature.
• Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
• A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original notification.

Send the counter-notice to the same email address listed above, with the subject line "DMCA Counter-Notice - [Game Title]".

5. Repeat Infringers

In line with standard practice, we reserve the right to remove from the catalog any game whose developer or publisher is the subject of repeated, valid infringement claims. We also reserve the right to refuse to work with developers who, in our reasonable judgment, repeatedly submit infringing material to the site.

6. Good-Faith Misrepresentations

Be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages. Please make sure you have a reasonable, good-faith basis before sending a takedown notice, and please do not use the DMCA process to silence criticism or to extract payment for legitimate use.

7. International Copyright Concerns

If you are based outside the United States and prefer to file a notice under your local copyright law rather than the DMCA, you are welcome to do so. Send us the notice in English, with the same substantive elements listed above, and we will process it on a comparable timeline. We respect copyright laws in the jurisdictions where our players live and will work with you in good faith.
